U.S. Court of Appeals for the Eighth Circuit upholds Summary Judgment ruling for Dowd Bennett client

Dowd Bennett Partners Jim Bennett and Jennifer Kingston represented Nucor Corporation in the U.S. Court of Appeals for the Eighth Circuit on an appeal of the district court’s grant of summary judgment to Nucor on plaintiff’s claims under the Family and Medical Leave Act (“FMLA”).  On March 1, 2018, the Eighth Circuit affirmed the summary judgment entered in Steve Curtis v. Nucor Corporation, No. 17-1388.  The Eighth Circuit, agreeing with Nucor, held that there was no genuine issue of material fact as to whether the plaintiff was entitled to FMLA leave for either an acute or a chronic condition.  Accordingly, the Eighth Circuit affirmed the district court’s grant of summary judgment.
