Unanimous Jury Returns Verdict in Favor of Dowd Bennett client Fresenius Medical Care
On August 15, 2012, a unanimous jury in the District of Massachusetts (Boston) returned a verdict in favor of Dowd Bennett client Fresenius Medical Care. The verdict determined that Fresenius was entitled to an additional deduction of $95 million on its 2000 and 2001 tax returns associated with a False Claims Act settlement payment made by the Company during those tax years. The case was tried against the United States Department of Justice’s Tax Division.
