Dowd Bennett Secures Full Summary Judgment and Dismissal with Prejudice for Edward Jones

On February 2, 2022, Dowd Bennett Partner Michelle Nasser and Associate Adam Simon obtained full summary judgment in favor of Edward Jones in the U.S. District Court for the Western District of Texas (San Antonio) on a former Edward Jones employee’s claim of retaliation.  The district court held that the plaintiff failed to establish a prima facie case of retaliation because there was no causal connection between a protected activity and termination of his employment.  The court found that Edward Jones terminated the plaintiff’s employment for legitimate, nonretaliatory, and non-pretextual reasons.  The court dismissed the case with prejudice.   The case is Emilio Lira v. Edward Jones Investments, Case SA-20-CV-00007-JKP (WDTX).
