Federal Suit Dismissed Against Corporate Officer Represented by Dowd Bennett

On March 24, 2010, a federal lawsuit against a corporate officer represented by Dowd Bennett attorneys Ed Dowd and John Comerford was dismissed upon motion of the defendants. The suit alleged that Dowd Bennett’s client and other defendants breached their fiduciary duties in administering an ERISA plan.

Dubinsky et al. v. Mermart, LLC

In February, 2010, the United States Court of Appeals for the Eighth Circuit affirmed the district court’s order dismissing all of plaintiffs’ claims against Dowd Bennett’s client Mermart, LLC.

Zoltek Inc. et al. v. Structural Polymer Group Ltd.

In January, 2010, the United States Court of Appeals for the Eighth Circuit affirmed the District Court’s order of dismissal of all claims against Dowd Bennett’s client, Structural Polymer Group, Ltd.

Olson v. Halvorsen et al.

The Delaware Supreme Court affirmed the verdict Dowd Bennett won in the Delaware Chancery Court on behalf of the Viking Global hedge fund and its founder.

Contos v. Anheuser-Busch Companies, Inc.

After successfully removing the lawsuit filed in the Circuit Court of the State of Missouri against its client, Anheuser-Busch Companies, Inc., to federal court, Dowd Bennett prevailed on its motion to dismiss plaintiff’s petition.

Herschel, et al. v. Nixon, et al.

In June of 2009, John Comerford successfully sued the Governor of the State of Missouri to prevent the termination of three Administrative Law Judges in the Missouri Division of Workers’ Compensation.
