No. 25-BC01XB-0030  Preston Hollow Capital, LLC, et al v. Truist Bank, etc. 2026 Tex. Bus. 59 (August 17, 2026)

Texas Business Court Decision – August 14, 2026

On October 7, 2026, the Fifteenth Court of Appeals granted plaintiffs’ petition for permissive appeal pursuant to Section 51.014 of the Civil Practice and Remedies Code. The Business Court order granting permission to appeal set out the following issue: “Whether the Texas Trust Code, and its non-waivable duties to act in good faith and in accordance with the purpose of the trust, apply to the trust instruments at issue in this case.” The Court of Appeals concluded this was a controlling question of law as to which there is a substantial ground for difference of opinion and that immediate appeal may advance the ultimate termination of the litigation.

The Fifteenth Court of Appeals case number is 15-26-00170-CV; the caption is unchanged.
