Dowd Bennett Obtains Jury Verdict for Emerson

On December 7, 2012, Dowd Bennett lawyers obtained a $5.3M jury verdict for Fisher Controls, a subsidiary of Emerson Electric Co., in the U.S. District Court for the Eastern District of Missouri.  The verdict on Emerson’s counterclaim followed the earlier dismissal of the plaintiff’s claims for antitrust conspiracy, monopolization, false advertising and other business torts.  The jury trial focused on Emerson’s claims for breach of contract and misappropriation of trade secrets.  The case also resulted in a permanent injunction relating to the plaintiff’s advertising claims and use of Emerson trademarks.  The case is Process Controls Int’l d/b/a Automation Service v. Emerson Process Management LLP, et al., No. 4:10-cv-006450CDP.  Partners Jim Bennett, John Comerford, Gabriel Gore and Megan Heinsz were on the trial team, which handled all witnesses and arguments.
