Missouri Eastern District Reverses $5 Million Judgment Against Dowd Bennett Client
The Missouri Eastern District Court of Appeals reversed entry of a $5 million judgment in a garnishment action against Columbia Casualty Company. The garnishment action sought coverage for a class action settlement of $5 Million for statutory penalties under the Telephone Consumer Protection Act, which was granted by the trial court. Dowd Bennett attorney Jim Bennett argued the case on appeal. Also working on the case were Dowd Bennett attorneys Jennifer Kingston and Selena Gillham. The Eastern District reversed and remanded for entry of summary judgment in favor of Columbia because statutory penalties were not covered by the insurance policy at issue.
