The lawyers at Dowd Bennett have extensive experience in appellate litigation. Jim Bennett has briefed or argued cases in the United States Circuit Courts of Appeals for the Second, Sixth, Seventh, Eighth, and Eleventh Circuits. He has argued cases in the Missouri and New Jersey state courts of appeals and has briefed cases in many other appellate courts. As a former judicial clerk in the United States Supreme Court and United States Court of Appeals, he has experience observing the appellate decision-making process first-hand.

Megan Heinsz clerked in the Missouri Court of Appeals for the Western District of Missouri, and Robert Epperson clerked for the Hon. Raymond Price, justice of the Missouri Supreme Court.

U.S. ex rel. Gebert v. Transportation Administrative Services, 260 F.3d 909, (8th Cir. 2001) (affirming award of summary judgment in false claims act case based on judicial estoppel triggered by the relator's prior bankruptcy proceeding).

BBSerco v. Green Bay Dressed Beef, 324 F.3d 955 (8th Cir. 2003) (appeal of trial court judgment from the Northern District of Iowa).

Dabush v. Mercedes Benz, 874 A.2d 1110 (N.J. App. 2005)(affirming award of summary judgment in a class action related to the navigation system in the 2000 model-year S-Class Mercedes automobile).

Theidemann v. Mercedes Benz, 849 A.2d 196 (N.J. App. 2004) (appeal of case involving claim of breach of warranty based on fuel-sending unit in several model years of multiple models). Link to opinion

Service Vending Corp. v. Wal-Mart Stores, Inc., 93 S.W.3d 764 (Mo. App. 2002) (successful appeal of $51.5 million jury verdict against our client; appeal resulted in outright reversal of the judgment).

Bonner v. Western Star Trucks, 330 F.3d 1308 (11th Cir. 2003) (appeal of complex removal question in class action involving major truck manufacturer).

Pamela Huber v. Wal-Mart Stores, 486 F.3d 480 (8th Cir. 2007) (appeal of adverse decision that Wal-Mart's promotion policy violated the Americans with Disability Act; judgment against Wal-Mart was reversed).
